How Do I Apply For A GI Tag In India?

Answer By law4u team

A Geographical Indication (GI) tag is a form of intellectual property that signifies a product's unique origin, quality, or reputation linked to a specific region or locality. In India, obtaining a GI tag provides legal protection to products, ensuring that they are recognized as originating from a particular region, which helps prevent misuse and counterfeiting. The application process is straightforward but requires adherence to specific legal steps.

Steps to Apply for a GI Tag in India:

Eligibility Check: Ensure that the product meets the criteria of a Geographical Indication, meaning it has a unique geographical origin, reputation, or specific quality linked to the region.

Form a GI Association or Group: The application must be filed by an association of producers or a group of stakeholders from the region linked to the product. The group must collectively apply for the GI tag.

Documentation and Evidence: Gather and submit evidence proving the product’s unique connection to the region, including historical documentation, quality evidence, and proof of traditional production methods.

Prepare the Application: Fill out the prescribed application form available from the Geographical Indications Registry in India. The application should include details of the product, its geographical origin, and a description of the product’s qualities.

Submit the Application: Submit the completed form along with all necessary documents and fees to the Geographical Indications Registry, which is a part of the Controller General of Patents, Designs, and Trademarks.

Examination of the Application: The registry will examine the application for any discrepancies and ensure all requirements are met. If required, the applicant may need to respond to objections or provide further clarification.

Publication in GI Journal: If the application is successful, it will be published in the Geographical Indications Journal for a public opposition period. During this period, any objections can be raised by interested parties.

Grant of GI Tag: If there are no objections, the GI tag is granted, providing legal protection to the product and its region.

Legal Actions and Protections:

Infringement Protection: Once a GI tag is granted, any unauthorized use of the name or product can lead to legal action for infringement. The GI tag acts as a safeguard to protect the product's reputation.

Monitoring and Enforcement: Regular checks and monitoring can be conducted to ensure the proper use of the GI tag, with actions taken against counterfeit products.

Example:

If a group of traditional weavers in Varanasi wishes to apply for a GI tag for their Banarasi sarees, they would:

  • Form a collective of weavers in the region.
  • Gather documentation showing the historical and cultural significance of Banarasi sarees.
  • Submit the application to the Geographical Indications Registry, demonstrating the saree's unique characteristics and the method of weaving passed down through generations.

After the application is reviewed and there are no objections, the Banarasi saree will receive the GI tag, protecting its brand and preventing unauthorized production elsewhere.
