What is the limitation period to file a consumer complaint?

The limitation period is the time frame within which a consumer must file a complaint after discovering a defect in goods or deficiency in services. This ensures timely redressal and prevents stale claims. Under the Consumer Protection Act 2019, the limitation period varies depending on the type of complaint and the forum where it is filed. Knowing this time limit is crucial for consumers to avoid losing their legal right to seek justice.

Limitation Period for Filing Consumer Complaints

  • District Consumer Forum (District Commission): Complaints must be filed within 2 years from the date on which the cause of action arises (i.e., when the defect or deficiency is discovered).
  • State Consumer Commission: For complaints where the value of goods or services and compensation claimed exceeds the limit of the District Commission, complaints can be filed within 2 years from the date of cause of action.
  • National Consumer Commission: For complaints involving very high-value claims or appeals from State Commissions, the time limit remains 2 years from the date of cause of action, though appeals can also consider shorter durations depending on forum rules.

Condonation of Delay

  • Consumer Forums have the power to accept complaints filed after the limitation period if the consumer can provide sufficient reasons for the delay.
  • Reasons for delay may include:
    • Late discovery of defect or deficiency
    • Medical emergencies or serious illness
    • Other reasonable and unavoidable circumstances

Practical Considerations

  • Filing complaints early is advisable to ensure easier collection of evidence and timely resolution.
  • Delay in filing may reduce the chances of recovery, especially if the product is perishable or the service issue becomes obsolete.

Example

  • A consumer buys a washing machine on January 1, 2023. It starts malfunctioning on December 15, 2023.
  • The consumer discovers the defect and immediately contacts the seller.
  • If no satisfactory response is received, the consumer can file a complaint within 2 years from December 15, 2023, i.e., by December 14, 2025, at the District Consumer Forum.
  • If the consumer delays filing until February 2026 due to illness, they must provide a reasonable explanation for the delay for the Forum to consider the complaint.

This limitation period ensures timely redressal while protecting consumer rights against prolonged delays.
