Steps to File a Complaint in Consumer Court

Identify the Appropriate Forum

  • District Consumer Forum (DCF): For claims up to ₹1 crore.
  • State Consumer Commission (SCC): For claims between ₹1 crore and ₹10 crore.
  • National Consumer Commission (NCC): For claims above ₹10 crore or appeals against SCC orders.

Draft the Complaint

  • Include your personal details, details of the goods or services, nature of the grievance, and the compensation or relief sought.
  • Attach supporting documents like bills, receipts, warranty cards, email/chat records, notices sent to the seller/service provider, and photographs if applicable.

Filing the Complaint

  • Complaints can be filed offline at the respective Consumer Court office or online through the official e-Daakhil portal.
  • Pay the prescribed court fee depending on the value of the claim.

Notice to Opposite Party

  • The court sends a notice to the seller/service provider (opposite party) to respond within a specified period.

Response and Mediation

  • Opposite party submits a reply to the complaint.
  • Courts often encourage mediation or conciliation to settle the dispute amicably.

Hearing and Evidence

  • Both parties present evidence and arguments before the Consumer Court.
  • Witnesses, documents, or expert opinions may be produced to strengthen the case.

Order/Relief

  • The court delivers a judgment granting relief, which may include refund, replacement, compensation for damages, or corrective action.

Appeal Process

  • If unsatisfied with the order, the consumer can appeal:
    • DCF → SCC → NCC
    • SCC → NCC
  • Appeals must be filed within the time frame specified by the Act.
