What compensation can be claimed for online product malfunction?

Answer By law4u team

Purchasing products online has made shopping convenient, but it also comes with the risk of receiving defective or malfunctioning products. This could range from electronics not working, appliances failing to perform, or damaged goods that are not fit for use. Under the Consumer Protection Act, 2019, consumers are protected against such defective products and are entitled to compensation, including repair, replacement, or refund. Consumers can approach the seller, manufacturer, or even consumer forums if the issue is not resolved.

Compensation Consumers Can Claim for Online Product Malfunction

Repair of the Defective Product

  • If the malfunctioning product can be repaired, the consumer has the right to request the seller or manufacturer to repair the item without any cost.
  • The repair should be done within a reasonable period, and the cost of the repair should be borne by the seller or the manufacturer if the product is under warranty or falls under the category of defective products.

Replacement of the Malfunctioning Product

  • If a product cannot be repaired or if the repair is not feasible, consumers are entitled to ask for a replacement of the defective item.
  • If a consumer buys a defective electronic item (like a smartphone or laptop), they can demand a new replacement or equivalent model.
  • The replacement should be free of charge, especially if the product is still under warranty.

Refund of the Purchase Price

  • If the product is beyond repair or the replacement is not feasible, the consumer has the right to seek a refund of the total amount paid for the product.
  • A refund is applicable in cases where the product is either not fit for the purpose it was intended for, or if the product does not match the description provided at the time of sale.

Compensation for Inconvenience and Financial Loss

  • If the defective product causes inconvenience or results in financial loss, consumers may be entitled to compensation for mental distress, loss of time, and other associated damages.
  • For instance, if a defective refrigerator caused food spoilage, the consumer can seek compensation for the financial loss due to the spoiled goods.
  • Consumers can also seek compensation for legal costs if they need to go through a formal process, such as approaching consumer forums or courts.

Reimbursement for Damaged Goods

  • In the case of damaged goods that are received in a non-functioning state (e.g., cracked screen on a phone or broken appliance), the consumer can seek reimbursement for any repair costs or claim full refunds.
  • If the damage occurred due to poor packaging or negligence by the seller, the consumer can hold the seller responsible for the damage.

Steps for Filing a Complaint Against a Malfunctioning Online Product

Contact the Seller/Manufacturer

  • Report the issue immediately to the seller or manufacturer, stating the details of the product and the defect/malfunction. Provide clear evidence, such as photos, videos, and receipts.
  • Most online sellers or platforms (like Amazon, Flipkart, eBay) have dedicated return or replacement policies for defective products.

Request Repair, Replacement, or Refund

  • Clearly specify whether you want the product repaired, replaced, or if you are seeking a refund.
  • Ensure that the product warranty (if applicable) is still valid, as it entitles you to free repairs, replacements, or a refund.

Use the Seller's Customer Service or Dispute Resolution Channels

  • Most online platforms have a dispute resolution system to address product-related issues. For instance, Amazon’s A-Z Guarantee offers protection for defective products.
  • If the issue is not resolved, escalate the complaint to the customer service supervisor or the dispute resolution department.

File a Complaint with Consumer Protection Authorities

  • If the seller refuses to address the issue, consumers can file a complaint with the National Consumer Helpline or the Consumer Forum for further redressal under the Consumer Protection Act, 2019.

Approach the Consumer Forum or Court

  • If the matter is still unresolved and the consumer has incurred financial loss, they can approach the consumer forum or consumer court for a solution.
  • The forum may order a refund, replacement, or compensation for damages caused by the defective product.

Consumer Rights Under the Consumer Protection Act, 2019

Right to Be Informed

  • Consumers are entitled to accurate information regarding the quality, quantity, and features of the product. If the product is defective or malfunctions, it means that the seller failed to provide goods that match the description or specifications.

Right to Seek Redressal

  • Under the Consumer Protection Act, consumers have the right to seek redressal for defective products. They can claim repair, replacement, or refund under the Act if the product is found to be faulty.

Right to Protection Against Unfair Trade Practices

  • A defective product sold online constitutes an unfair trade practice. The consumer has the right to complain and seek appropriate redressal for such practices under the Act.

Right to Compensation

  • If the defective product caused financial loss, mental distress, or inconvenience, the consumer has the right to seek compensation for the same.

Example:

Scenario: A consumer purchases a washing machine online from an e-commerce platform. Upon installation, the machine fails to start. The consumer immediately contacts the seller, who sends a technician to inspect the product. The technician confirms that the motor is defective and cannot be repaired.

Steps Taken:

  • The consumer requests a replacement or refund from the seller.
  • The seller agrees to replace the washing machine with a new one of the same model.
  • In the meantime, the consumer claims compensation for the mental distress and inconvenience caused by the defective product.
  • If the seller had refused to replace the item, the consumer could have filed a complaint with the consumer court to seek a refund, replacement, and compensation for the inconvenience.

Outcome:

  • The consumer receives a new washing machine and compensation for the inconvenience caused by the defective product.

Conclusion:

Consumers who receive malfunctioning or defective products from online stores have the right to repair, replacement, or refund under the Consumer Protection Act, 2019. They are also entitled to compensation for any financial loss or mental distress caused by the defective product. If a resolution is not reached with the seller, consumers can escalate the matter to consumer forums or consumer courts to ensure their rights are protected.
