What is the limitation period for filing complaints against online fraud?

Answer By law4u team

Online fraud cases, including phishing, fake websites, unauthorized bank or payment app deductions, and fraudulent e-commerce transactions, require timely action for consumer protection and legal recourse. Indian law prescribes specific limitation periods to ensure complaints are lodged while evidence is fresh, and authorities can investigate efficiently. Awareness of these timelines is critical to securing refunds, compensation, or corrective action.

Limitation Period for Filing Complaints Against Online Fraud

Under the Consumer Protection Act 2019

  • Section 2(1)(c) and related provisions allow filing a complaint for deficiency in service, unfair trade practice, or online fraud.
  • The limitation period is generally 2 years from the date the cause of action arises (i.e., the date the fraud was noticed).
  • Complaints beyond this period may be rejected unless the consumer can provide valid reasons for delay.

Under the IT Act 2000

  • Cybercrime complaints, including hacking, identity theft, or online fraud, can be reported without strict limitation periods, but prompt reporting is encouraged for effective investigation.
  • Delayed reporting can make it difficult to recover lost funds or trace perpetrators.

Banking and Payment Regulations

  • RBI guidelines mandate that consumers report unauthorized or fraudulent banking transactions within 30–90 days of occurrence for faster resolution and refund.
  • Delay in reporting may reduce the chances of a full refund.

E-commerce Platforms

  • Most online marketplaces require reporting fraud within 7–30 days of the transaction to qualify for dispute resolution, replacement, or refund.
  • Keeping proof of transaction, emails, and screenshots is essential.

Consumer Safety Tips

  • Regularly monitor bank statements, credit card statements, and app notifications.
  • Report suspicious activity immediately to the bank, e-commerce platform, or cybercrime authorities.
  • Maintain all digital evidence such as emails, screenshots, and transaction receipts.
  • Enable two-factor authentication (2FA) and secure passwords to prevent fraud.
  • Use official complaint channels like National Consumer Helpline and National Cyber Crime Reporting Portal.

Example

A consumer notices a ₹12,000 deduction from their bank account for an online shopping order they never placed, discovered 40 days after the transaction.

Steps the consumer should take

  • Immediately inform the bank and request a reversal of the unauthorized deduction.
  • File a complaint with the e-commerce platform, providing transaction evidence.
  • If unresolved, lodge a complaint with the District Consumer Dispute Redressal Commission within 2 years from noticing the fraud.
  • Report the matter on the National Cyber Crime Reporting Portal for investigation.
  • Keep all documentation and communication logs to support claims for refund or compensation.
