  • Right to Clear and Accurate Information
    Consumers must receive clear, complete details about the product or service including price, specifications, delivery timelines, warranty, return and refund policies, and seller identity.
  • Right to Secure Payments
    Consumers have the right to use secure and trusted payment gateways that protect their financial data through encryption and comply with RBI and PCI DSS guidelines.
  • Right to Timely Delivery
    The seller must deliver the goods or services within the promised time frame. Delays without valid reasons constitute deficiency in service.
  • Right to Return, Replacement, or Refund
    Consumers can return products that are defective, damaged, or not as described and claim replacement or refund as per the seller’s policy or applicable laws.
  • Right to Privacy and Data Protection
    Personal and payment data collected during transactions must be protected and not misused. The IT Act and rules under the Consumer Protection Act enforce data privacy.
  • Right to Redressal and Complaint Filing
    Consumers can file complaints with the seller, e-commerce platform, or consumer courts if their rights are violated or services are deficient. Platforms must have a grievance redressal mechanism.
  • Right to Protection Against Unfair Trade Practices
    Misleading advertisements, false claims, hidden charges, or coercive sales tactics are prohibited, and consumers can seek legal remedy.
  • Right to Cancel Orders
    Consumers have the right to cancel orders before dispatch or within the stipulated time frame as per e-commerce policies without penalty.

Steps to Enforce Your Rights

  • Keep all transaction records, including invoices, emails, chats, and screenshots.
  • Contact the seller or e-commerce platform customer support with your complaint.
  • Use the platform’s grievance redressal mechanism and escalate if unresolved.
  • File a complaint with Consumer Disputes Redressal Commission if necessary.
  • Report cyber fraud or data theft to cybercrime authorities and the IT Ministry.

Example

A consumer orders a smartphone online, but the device delivered is defective. The consumer checks the return policy and raises a return request within 7 days. The seller refuses refund citing usage, but the consumer files a complaint with the District Consumer Forum attaching order details, warranty, and photos of the defect. The forum rules in favor of the consumer and orders refund with compensation for harassment.
