Can a consumer file complaints for delayed delivery of goods?

Timely delivery of goods is an essential part of the contract between a buyer and seller. Under the Consumer Protection Act, 2019, delay in delivery without a valid reason amounts to deficiency in service or unfair trade practice. Consumers are entitled to take legal action and seek remedies including refund, compensation, or cancellation of orders when goods are not delivered within the promised timeframe, especially in cases of online shopping or pre-paid purchases.

Consumer Rights Regarding Delayed Delivery

  • Right to receive goods within the agreed delivery period
  • Right to refund if delivery is not made within the promised time
  • Right to claim compensation for any loss or mental agony caused by delay
  • Right to cancel the order and stop payment in case of non-delivery
  • Right to complaint and seek legal remedy for service deficiency

Procedure to File Complaint for Delayed Delivery

  1. Document the Delay
    • Keep copies of the order confirmation, payment receipt, delivery promise date, and communication with the seller or delivery service.
    • Record any follow-up attempts you made to get delivery updates.
  2. Contact the Seller or E-Commerce Platform
    • Raise a complaint through customer support or grievance redressal channels.
    • Request a clear update and expected delivery timeline.
    • Demand refund or cancellation if the delay continues beyond reasonable time.
  3. Use Consumer Helplines and Ombudsman
    • Many e-commerce platforms have dedicated consumer grievance cells or ombudsman.
    • File complaints with such authorities for faster resolution.
  4. Send a Legal Notice
    • If the seller does not respond, send a formal legal notice demanding refund or delivery within a fixed time.
  5. File Complaint in Consumer Forum
    • Submit a complaint to the District, State, or National Consumer Commission depending on claim amount.
    • Attach proof of order, payment, communication, and delay details.
    • Seek refund, compensation for inconvenience, and cancellation of order.

  • Compensation for mental agony, financial loss, or consequential damages
  • Cancellation of order with refund
  • Penalty on seller for unfair trade practice or deficiency in service

Important Points

  • Complaints should be filed within 2 years from the date of breach (promised delivery date).
  • Retain all records related to the transaction and communication.
  • If payment was made via credit card or online wallets, dispute with payment provider may also be an option.

Example

A consumer orders a laptop online with a promised delivery of 10 days and pays ₹60,000 in advance. After 25 days, the laptop is still not delivered, and the seller stops responding. The consumer requests a refund, but the seller refuses. The consumer files a complaint in the District Consumer Forum with all payment receipts, order confirmation, and email correspondence. The forum orders the seller to refund the amount with ₹5,000 as compensation for mental harassment and ₹1,000 for litigation costs.
