What is the procedure to file complaints against defective consumer goods?

Answer By law4u team

Defective consumer goods can cause inconvenience, financial loss, and sometimes safety hazards. The Consumer Protection Act, 2019 provides a structured mechanism for consumers to file complaints and seek remedies such as repair, replacement, refund, or compensation. Understanding the correct procedure ensures timely and effective redressal of grievances.

Step-by-Step Procedure to File Complaints Against Defective Consumer Goods:

  • Identify and Document the Defect:
    • Inspect the product carefully to identify the defect.
    • Take clear photographs or videos of the defect.
    • Preserve the original packaging, warranty card, and purchase receipt.
  • Contact the Seller or Manufacturer:
    • Inform the seller or manufacturer about the defect as soon as possible, preferably in writing (email, letter, or registered post).
    • Request repair, replacement, or refund as per the warranty terms or consumer rights.
    • Keep copies of all correspondence.
  • Use the Manufacturer’s or Seller’s Grievance Redressal Mechanism:
    • Many companies have customer care or grievance redressal cells. Approach them for resolution.
    • Follow up regularly until the issue is resolved.
  • File a Complaint with Consumer Forum:
    • If the seller or manufacturer fails to resolve the issue within a reasonable time, file a complaint with the appropriate consumer forum based on the value of goods and compensation claimed:
      • District Consumer Forum: Claims up to ₹1 crore.
      • State Consumer Commission: Claims between ₹1 crore and ₹10 crores.
      • National Consumer Commission: Claims above ₹10 crores.
  • Prepare and Submit the Complaint:
    • Draft a clear complaint stating facts, defects, relief sought, and attach evidence such as bills, warranty cards, communication records, and photographs.
    • Submit the complaint either online or physically at the forum.
  • Attend Hearings and Present Your Case:
    • Attend the scheduled hearings and provide all necessary evidence.
    • The opposite party will also be heard.
    • The forum will decide on appropriate relief after examination.
  • Enforcement of Orders:
    • Once an order is passed, the forum ensures compliance.
    • If the party does not comply, legal enforcement measures can be initiated.

Legal Rights and Remedies:

  • Right to Repair: Free repair within warranty or reasonable time.
  • Right to Replacement: If repair fails or is impossible.
  • Right to Refund: Full or partial refund for defective goods.
  • Right to Compensation: For loss, injury, or mental agony caused by defective products.

Tips for Consumers:

  • Always keep purchase receipts and warranty documents safely.
  • Report defects promptly to avoid losing warranty benefits.
  • Use registered communication methods to create proof.
  • Seek expert opinions or technical reports if necessary.
  • Be aware of the limitation period for filing complaints (usually 2 years from the date of purchase or discovery of defect).

Example:

  • A consumer buys a new refrigerator which stops cooling within 3 months.
  • The seller’s service center tries to repair it but fails repeatedly.
  • The consumer writes to the seller requesting replacement or refund, but no action is taken.
  • The consumer files a complaint in the District Consumer Forum with all documents.
  • The forum orders the seller to replace the refrigerator or refund the purchase price and pay compensation for inconvenience.
