What are the powers of the Central Consumer Protection Authority?

Answer By law4u team

The Central Consumer Protection Authority (CCPA) was established under the Consumer Protection Act, 2019 as a powerful regulatory body to promote, protect, and enforce the rights of consumers. It acts as a watchdog against unfair trade practices, false or misleading advertisements, and unsafe goods and services. Unlike traditional consumer courts, CCPA has both administrative and quasi-judicial powers, including the ability to launch investigations, impose penalties, and initiate corrective measures.

Key Powers of the Central Consumer Protection Authority

1. Regulation of Unfair Trade Practices

  • Misleading advertisements
  • Deceptive marketing tactics
  • Unfair terms of sale or service
  • Hidden charges or fake offers

2. Power to Conduct Investigations

  • CCPA can initiate investigations suo motu (on its own), on complaints, or based on directions from the government.
  • It can refer cases to the Director General (Investigation) to carry out inquiries and collect evidence.

3. Power to Issue Directions and Orders

  • Direct businesses to cease and desist from unfair practices.
  • Order discontinuation of misleading advertisements.
  • Issue warnings to traders, endorsers, and manufacturers.

4. Power to Impose Penalties

  • CCPA can impose fines up to ₹10 lakh for a first offence related to misleading advertisements, and up to ₹50 lakh for repeated offences.
  • Celebrities and endorsers can also be penalized if they endorse false claims without due diligence.

5. Power to Recall Products and Withdraw Services

  • Direct companies to recall unsafe, hazardous, or defective products.
  • Order withdrawal of harmful services from the market.
  • Ensure refund of the purchase amount to affected consumers.

6. Power to File Complaints in Consumer Commissions

  • CCPA can represent the interests of a large group of consumers by filing complaints directly in District, State, or National Consumer Disputes Redressal Commissions.

7. Power to Initiate Class Action

  • Take suo motu action or act on behalf of a group of consumers suffering from a common issue (such as mass fraud, faulty goods, etc.).

8. Oversight of E-commerce and Digital Trade

  • Monitor compliance of online platforms with Consumer Protection (E-commerce) Rules, 2020.
  • Address fake reviews, deceptive discounts, and non-disclosure of seller details.

Enforcement Tools at CCPA’s Disposal

  • Search and Seizure under legal warrants
  • Summoning of persons and requiring production of documents
  • Inspection of premises of sellers or manufacturers
  • Public warning notices and blacklisting of repeat offenders

Example

  • A company advertises a herbal supplement claiming 100% cure for diabetes. Consumers suffer side effects, and the product is found to be unregulated:
  • CCPA receives multiple complaints and initiates investigation.
  • Orders the company to stop the misleading advertisements, recall the product, and refund consumers.
  • Imposes a ₹25 lakh penalty on the company and ₹10 lakh on the celebrity who endorsed it.
  • Also files a case in the National Consumer Commission on behalf of affected consumers.

Conclusion

The Central Consumer Protection Authority plays a critical role in strengthening consumer rights in India. With broad powers to investigate, penalize, recall products, and even sue businesses, CCPA ensures that consumers are not exploited by unethical or unsafe business practices. It serves as a proactive and preventive body that complements the traditional redressal system by enforcing compliance and deterring violations.
