What is the procedure for filing complaints for product defects?

Answer By law4u team

Defective products can cause inconvenience, financial loss, and safety hazards to consumers. The Consumer Protection Act, 2019 empowers consumers to seek redressal for defective goods through a simplified legal process. Understanding the proper procedure to file complaints ensures faster resolution and effective compensation.

Procedure for Filing Complaints for Product Defects

1. Collect Evidence

  • Retain the purchase invoice, warranty card, and packaging of the product.
  • Document the defect clearly by taking photographs or videos.
  • Keep records of any communication with the seller or manufacturer regarding the defect.

2. Contact the Seller or Manufacturer

  • Inform the seller or manufacturer about the defect and request repair, replacement, or refund.
  • Often, companies have customer service helplines or grievance cells to handle such complaints.

3. Write a Formal Complaint

  • If the seller/manufacturer fails to resolve the issue, draft a written complaint stating:
    • Details of the product and defect
    • Purchase details
    • Attempts made to resolve the issue
    • Relief sought (refund, replacement, or compensation)

4. File Complaint in Consumer Forum

  • Based on the value of the claim, file the complaint with:
    • District Consumer Disputes Redressal Commission (claims up to ₹50 lakh)
    • State Consumer Disputes Redressal Commission (claims between ₹50 lakh and ₹2 crore)
    • National Consumer Disputes Redressal Commission (claims above ₹2 crore)
  • Submit the complaint along with copies of all supporting documents and evidence.

5. Pay the Prescribed Fee

  • Pay the nominal filing fee as prescribed by the forum based on the claim amount.

6. Attend Hearings and Present Your Case

  • Attend hearings personally or through a lawyer to present evidence and arguments.
  • The opposite party (seller/manufacturer) will also be heard.

7. Follow the Forum’s Decision

  • The forum may order replacement, refund, compensation for damages, or repair of the defective product.
  • Compliance with the forum’s order is mandatory; non-compliance can lead to penalties.

Consumer Tips

  • Act promptly, as complaints must be filed within 2 years from the date of defect or cause of action.
  • Keep duplicates of all documents submitted to the forum.
  • Maintain polite and clear communication throughout the process.
  • Seek assistance from consumer rights groups or legal experts if necessary.

Example

A consumer buys a refrigerator which stops cooling within 3 months. After multiple failed repair attempts by the service center, the consumer:

  • Sends a written complaint to the manufacturer requesting replacement.
  • Receives no satisfactory response and files a complaint at the District Consumer Forum.
  • Submits all purchase documents, repair reports, and communication copies.
  • The forum orders the manufacturer to replace the refrigerator and pay ₹10,000 as compensation for inconvenience.

Conclusion

Filing complaints for defective products is a structured process designed to protect consumer rights. By collecting proper evidence, following the complaint procedure, and approaching consumer forums, consumers can effectively seek remedies such as refunds, replacements, or compensation under the Consumer Protection Act, 2019.
