Can a consumer approach consumer courts for online banking fraud?

Answer By law4u team

With the rising use of online banking, instances of cyber fraud and financial scams have also increased, causing significant losses to consumers. Legal frameworks and consumer protection laws have evolved to address such challenges. Consumers have the right to seek justice not only through cybercrime reporting channels but also by approaching consumer courts for compensation and redressal related to online banking fraud.

Can Consumers Approach Consumer Courts for Online Banking Fraud?

Dual Approach: Cybercrime and Consumer Courts

Online banking fraud is both a cybercrime and a consumer dispute. Consumers can file complaints with cybercrime authorities (such as Cyber Cells or the National Cyber Crime Reporting Portal) for criminal investigation. Simultaneously, they can approach consumer courts for civil remedies like compensation.

Legal Provisions under Consumer Protection Act

The Consumer Protection Act recognizes banking services as services under its scope. Fraudulent or deficient banking services, including online fraud, fall under the definition of deficiency of service, enabling consumers to file complaints seeking compensation.

Steps to File Complaint in Consumer Court

  • Draft a detailed complaint outlining the fraud, losses, communication with the bank, and responses received.
  • Attach all evidence such as transaction records, bank statements, FIR copies, and correspondence.
  • File the complaint in the appropriate District, State, or National Consumer Disputes Redressal Forum based on claim amount.

Role of Banks

Banks are obligated to investigate fraud claims promptly and provide relief as per RBI guidelines and their own policies. Failure or delay in resolving the issue strengthens the consumer’s case in court.

Importance of Timely Reporting

Consumers must report fraud to their bank and cybercrime authorities immediately upon detection to strengthen their case for compensation.

Remedies Available

Consumer courts can order refund of lost money, compensation for mental agony, punitive damages, and directives for improved security measures by banks.

Alternative Dispute Resolution

Some consumer disputes may be resolved through mediation or settlement before the court hearing.

Consumer Precautions and Awareness

  • Use strong, unique passwords and two-factor authentication.
  • Regularly monitor bank statements and transaction alerts.
  • Avoid sharing OTPs or passwords with anyone.
  • Report suspicious transactions immediately.

Example

A consumer notices unauthorized transactions on their online banking account resulting in financial loss. Despite reporting to the bank, no refund or resolution is provided.

  • Lodge an FIR or complaint on the National Cyber Crime Reporting Portal.
  • File a detailed complaint with the consumer forum highlighting the bank’s failure to provide timely resolution.
  • Attach transaction statements, correspondence, and cybercrime complaint proof.
  • Follow up with both cyber authorities and consumer courts until justice is served.
  • Implement enhanced security measures on their banking accounts.

This dual legal recourse empowers consumers to tackle online banking fraud effectively, ensuring accountability from banks and protecting consumer rights in the digital age.
