Can a consumer file complaints for defective home appliances?

Consumers have the right to file complaints against defective home appliances under the Consumer Protection Act, 2019. Home appliances such as refrigerators, washing machines, air conditioners, microwaves, and other electrical or electronic devices that fail to perform as promised or have manufacturing defects qualify for legal redress. The Act safeguards consumer interests by allowing claims for repair, replacement, refund, or compensation.

Filing Complaints for Defective Home Appliances

  • 1. Verify Warranty and Defect

    Check if the appliance is under warranty or guarantee period. Identify the specific defect, malfunction, or failure that affects its performance.

  • 2. Approach Seller or Manufacturer

    Inform the seller or manufacturer about the defect and request repair, replacement, or refund as per warranty terms. Maintain records of all communications.

  • 3. Collect Documentation

    Keep all purchase receipts, warranty cards, service reports, and correspondence with the seller or manufacturer as proof.

  • 4. File a Complaint with Consumer Forum

    If the seller/manufacturer refuses to resolve the issue satisfactorily, file a complaint in the District Consumer Forum (claims up to ₹1 crore), State Commission (₹1 crore to ₹10 crores), or National Commission (above ₹10 crores) based on the value of the appliance or claim.

  • 5. Draft the Complaint

    Clearly state the defect, the relief sought (repair, replacement, refund, compensation), and attach supporting documents.

  • 6. Submit and Attend Hearings

    Submit the complaint offline or online (via E-Daakhil portal). Attend hearings and provide evidence of the defect and attempts to resolve the matter amicably.

  • 7. Remedies

    The consumer forum may order repair, replacement of the defective appliance, refund of the purchase price, or compensation for loss or inconvenience caused.

Scenario:

A consumer buys a washing machine that stops functioning properly within two months. The service center refuses to repair it under warranty.

Steps the consumer should take:

  • Contact the manufacturer and document all correspondence.
  • If unresolved, collect all receipts, warranty card, and complaint copies.
  • File a complaint in the District Consumer Forum citing defective product and refusal to repair.
  • Request replacement or refund along with compensation for inconvenience.
  • Attend hearings and present evidence.
  • Obtain a court order for appropriate relief.
