Can a consumer approach the Consumer Court for utility service deficiencies?

Yes, consumers can approach Consumer Courts (District, State, or National Consumer Disputes Redressal Commissions) for deficiencies in utility services. Utility services like electricity, water, gas, telephone, and sanitation are considered essential services under the Consumer Protection Act, 2019. If a consumer faces negligence, delay, deficiency in quality, or unfair trade practices related to these services, they have the right to seek compensation or corrective action through consumer forums.

Legal Provisions for Utility Service Deficiencies

Under the Consumer Protection Act, 2019, service includes the provision of utilities like electricity, water, telephone, and gas. Any failure in performance, negligence, or deficiency in these services amounts to a deficiency of service. Consumers are entitled to complain against:

  • Interruption or irregular supply
  • Poor quality or contaminated supply
  • Overcharging or unfair billing
  • Failure to provide promised services
  • Negligence causing loss, damage, or harassment

How Consumers Can Approach Consumer Courts for Utility Service Deficiencies

  • 1. Identify the Appropriate Forum

    District Consumer Forum if the claim is up to ₹1 crore.

    State Consumer Commission for claims above ₹1 crore and up to ₹10 crores.

    National Consumer Commission for claims exceeding ₹10 crores.

  • 2. Gather Evidence

    Collect all relevant documents like bills, payment receipts, complaint letters, acknowledgment from utility providers, photographs or videos of the defect or problem, and communication records.

  • 3. Attempt Resolution with Service Provider

    Consumers should first complain to the utility service provider and give them a reasonable time to rectify the issue. Keeping records of these complaints is important.

  • 4. Draft and File a Complaint

    If the service provider fails to resolve the issue, the consumer can file a complaint in the appropriate consumer forum. The complaint must mention the nature of deficiency, details of service provider, relief sought (refund, compensation, service restoration), and include all supporting documents.

  • 5. Follow the Hearing Process

    The consumer forum will examine the complaint, call the parties for hearings, and after considering evidence, deliver a judgment.

  • 6. Relief and Compensation

    If the complaint is upheld, the forum may order compensation for losses or harassment, refund of charges, discontinuation of unfair practices, or any other appropriate remedy.

Scenario:

A consumer receives an electricity bill with an exorbitant amount due to faulty meter reading. Despite several complaints to the electricity department, the issue is not resolved, and power supply is irregular causing inconvenience.

Steps the consumer should take:

  • Lodge a formal written complaint with the electricity department and keep proof of the complaint.
  • If unresolved within a reasonable time, file a complaint with the District Consumer Forum citing deficiency in service and harassment.
  • Attach copies of bills, complaint letters, and any communications.
  • Attend the hearings and present the case.
  • The forum may order corrected billing and compensation for mental agony or losses due to power interruption.
