How can consumers get refunds through consumer courts?

1. Identify the Ground for Refund

  • Poor Services: If the service provided (e.g., telecommunications, hotel services, or repair services) was not delivered as agreed.

  • Contact the seller or service provider directly and request a refund.
  • Follow the company’s refund policy and adhere to any timelines for claims.
  • Send a formal letter or email requesting a refund, including the reason for dissatisfaction and evidence (receipts, communications, etc.).
  • Escalate the matter to higher management if the initial customer support does not resolve the issue.

If the seller refuses or delays the refund, the consumer has the option of moving forward with the legal process.

3. Filing a Complaint in Consumer Court

If the business does not provide a satisfactory resolution, the consumer can file a complaint with the appropriate consumer forum. The forum’s jurisdiction will depend on the value of the claim:

  • District Consumer Forum: For claims up to ₹1 crore.
  • State Consumer Commission: For claims exceeding ₹1 crore but less than ₹10 crore.
  • National Consumer Commission: For claims above ₹10 crore.

4. Steps Involved in the Filing Process

To file a complaint in a consumer court:

  • Draft a complaint: The consumer can write the complaint by providing a clear explanation of the issue, stating the relief sought (refund in this case), and attaching supporting documents.
  • Pay the filing fee: A nominal fee is required to file the complaint, which varies depending on the value of the claim.
  • Submit the complaint: The complaint can be submitted online (for certain forums) or in person at the relevant consumer forum.
  • Attend the hearings: After filing, the forum will schedule a hearing where the consumer and the seller/service provider can present their cases.

5. Action by Consumer Court

Once the consumer forum has received the complaint, the court will:

  • Summon both parties: The forum may issue a summons to the seller/service provider to present their side of the case.
  • Examine evidence: The forum will examine all evidence, including receipts, warranties, communications, and any other documents submitted by both parties.

The forum has the power to:

If the seller or service provider refuses to comply with the court’s order, the consumer forum can take enforcement actions, such as:

  • Issuing a recovery warrant to enforce the refund.
  • Imposing fines or penalties on the business for non-compliance.
  • Involving law enforcement to ensure the execution of the order if necessary.

The consumer can also appeal to higher courts (State or National Commission) if they are dissatisfied with the consumer forum's decision.

A consumer buys a washing machine from a well-known electronics store. After using it for a few months, the machine breaks down. Despite multiple repair attempts, the issue persists. The consumer contacts the store for a refund, but the store refuses.
