  • Accurate product descriptions: Sellers must provide true details about the products, such as price, features, ingredients (for food), and warranty terms.
  • Seller information: The identity and contact information of the seller must be disclosed, including details about their physical address and customer support.
  • Return and Refund Policy: Clear policies regarding returns, exchanges, and refunds should be available to consumers before making a purchase. This ensures that consumers are aware of their rights in case of defects, misrepresentation, or dissatisfaction with the product.
  • Grievance Redressal Mechanism

Under the CPA, e-commerce platforms are required to have a grievance redressal mechanism to address consumer complaints efficiently. Key points include:

  • Dedicated grievance officer: E-commerce platforms must appoint a grievance officer to handle consumer complaints.
  • Timely resolution: Complaints must be resolved within a specified period (usually 30 days).
  • Escalation mechanisms: If the issue is not resolved satisfactorily, consumers can escalate their complaint to the Consumer Protection Authority or approach a consumer forum for further legal recourse.
  • Protection Against Counterfeit Products

The CPA places responsibility on e-commerce platforms to ensure the authenticity of the products they sell. Consumers must not be sold counterfeit or substandard goods. If a consumer receives a fake product, they have the right to file a complaint under the Act. E-commerce platforms are required to:

  • Monitor and screen sellers to prevent the sale of counterfeit items.

The CPA enforces the right of consumers to cancel their online purchase within a stipulated time period and receive a full refund. The Act also stipulates that:

  • Sellers must honor the return policy: E-commerce platforms must clearly mention how and when a consumer can return a product and get a refund.
  • Consumers can approach forums for refunds in case of delay or non-fulfillment of return policies.
  • Addressing Online Payment Fraud

The Consumer Protection Act, 2019 also provides protection for consumers against fraudulent activities such as online payment fraud. In cases where a consumer is charged incorrectly or falls victim to fraudulent transactions, they can:

A consumer buys a smartphone from an e-commerce platform that is advertised as having 4K resolution camera and fast charging. However, upon receiving the product, the camera resolution is significantly lower, and charging is slower than advertised.

Steps Taken:

  • Contact the Seller: The consumer contacts the seller through the platform, citing the misleading product description.
  • Grievance Redressal: The consumer raises a complaint through the platform’s grievance redressal mechanism, asking for a refund and citing the false advertisement.
