How Can An Elder Citizen Obtain A Restraining Order Against An Abuser?

Answer By law4u team

Elder abuse victims have legal avenues to seek protection through restraining or protection orders. These orders prohibit the abuser from contacting, approaching, or harming the elder, providing a crucial safeguard against further harm. Several laws and procedures support elders in obtaining such orders efficiently.

Procedure to Obtain a Restraining Order

File a Complaint or Application

The elder or their representative can file a complaint at the local police station or an application before the Maintenance Tribunal under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007.

Approach the District Court or Magistrate

Protection orders can be sought from the district court or magistrate under relevant laws such as the Protection of Women from Domestic Violence Act, 2005 (if applicable), or under elder-specific provisions.

Provide Evidence of Abuse or Threat

Submit documents, medical reports, photographs, witness statements, or any proof supporting the claim of abuse or harassment.

Court Hearing and Order

The court hears the case and, if satisfied, issues a restraining or protection order directing the abuser to stay away from the elder.

Police Enforcement

The police enforce the order and can take action if it is violated.

Legal Provisions Supporting Restraining Orders

Maintenance and Welfare of Parents and Senior Citizens Act, 2007

Empowers elders to seek maintenance and protection from abuse.

Protection of Women from Domestic Violence Act, 2005

Applicable if abuse occurs within a domestic relationship.

Section 106 of the Code of Criminal Procedure (CrPC)

Court’s power to grant injunctions or restraining orders.

IPC Sections 341, 342, 506

Support actions against harassment, wrongful confinement, and intimidation.

Example

A 68-year-old woman facing continuous harassment from her son-in-law files a complaint at the local police station and simultaneously applies to the Maintenance Tribunal for a restraining order. The tribunal issues an order preventing the son-in-law from entering her residence or contacting her. The police ensure compliance and take action on any violations.

Steps taken:

Filed formal complaints with police and tribunal.

Provided evidence of harassment.

Obtained restraining order from the tribunal.

Police monitored and enforced the order.
