The Supreme Court of India has clarified that its February 12, 2026, judgment granting disability pension benefits and arrears to certain ex-servicemen cannot be automatically applied to every pension claim.
The order was passed on October 12, 2026, in a miscellaneous application filed by the Union of India in Civil Appeal No. 6820 of 2018, titled Union of India Through Its Secretary and Others versus Sgt Girish Kumar and Others.
In its earlier common judgment, the Court had dismissed the Union government's appeals and allowed appeals filed by ex-servicemen. It granted eligible personnel disability pension benefits, including the benefit of broad banding from January 1, 1996, or January 1, 2006, as applicable, along with 6% annual interest.
Union government's concerns
The Union government sought clarification, arguing that the earlier judgment concerned ex-servicemen who were already receiving disability pension and were seeking only its recalculation through broad banding.
The government informed the Court about 23 Air Force cases and 26 Army cases that had either been decided or were pending before High Courts or the Armed Forces Tribunal. It argued that the earlier ruling was being relied upon in other pension disputes, including cases where entitlement to disability pension itself had been contested.
The government expressed concern that extending the ruling mechanically could affect matters already settled and have administrative and financial consequences.
Court's clarification
After hearing Additional Solicitor General Archana Pathak Dave for the Union government and advocate M.V.R. Mukunda for the respondents, the bench comprising Justice Pamidighantam Sri Narasimha and Justice Alok Aradhe explained that judgments must be understood in the context of their specific facts.
The Court observed that a difference in facts may affect the precedential value of a decision. It clarified that the February ruling did not establish an automatic right to disability pension arrears in every case.
The Court stated: “Needless to state that each claim shall be decided on its own merits.”
Application disposed of
The Supreme Court disposed of the Union government's miscellaneous application, leaving individual pension claims to be assessed on their own facts and merits. The order does not withdraw the benefits granted in the earlier judgment to the ex-servicemen covered by it.
