Defective Summary Suit Need Not Be Dismissed Entirely; Underlying Claim Can Continue as an Ordinary Recovery Action: Jammu and Kashmir High Court

The High Court of Jammu & Kashmir and Ladakh has delivered an important judgment clarifying that a defective summary suit does not necessarily have to be dismissed as a dead suit.
