यदि प्रथम अपील प्राधिकारी मूल कार्यालय में मुख्य सूचना अधिकारी के गलत निर्णय को सही ठहराते हैं तो जुर्माना मूल कार्यालय द्वारा अदा किया जायेगा. भारत में सूचना का अधिकार अधिनियम, 2005 के तहत, मूल कार्यालय में मुख्य सूचना अधिकारी जनता को जानकारी प्रदान करने के लिए जिम्मेदार है, और यदि वे ऐसा करने में विफल रहते हैं, तो उन्हें दंडित किया जा सकता है। तथापि, यदि प्रथम अपील प्राधिकारी मुख्य सूचना अधिकारी के गलत निर्णय को बरकरार रखता है, तो इसका अर्थ है कि मुख्य सूचना अधिकारी के गलत निर्णय के कारण सूचना प्रदान नहीं की गई थी, और इसलिए, जुर्माना अदा करने के लिए मूल कार्यालय जिम्मेदार होगा। यह ध्यान रखना महत्वपूर्ण है कि प्रथम अपील प्राधिकारी इस मामले में दंड का भुगतान करने के लिए जिम्मेदार नहीं है क्योंकि वे केवल मुख्य सूचना अधिकारी द्वारा किए गए निर्णय की समीक्षा कर रहे हैं और मूल निर्णय के लिए जिम्मेदार नहीं हैं।
