भारत में, निम्नलिखित संस्थाएँ पेटेंट के लिए आवेदन करने के लिए पात्र हैं: व्यक्ति: कोई भी व्यक्ति जो आविष्कार का सच्चा और पहला आविष्कारक है, भारत में पेटेंट के लिए आवेदन कर सकता है। पेटेंट के लिए आवेदन करने के लिए व्यक्ति की आयु कम से कम 18 वर्ष होनी चाहिए और स्वस्थ दिमाग का होना चाहिए। कंपनियां: कोई कंपनी भारत में पेटेंट के लिए आवेदन कर सकती है यदि वह कंपनी अधिनियम, 2013, या अधिनियम के किसी पिछले संस्करण के तहत पंजीकृत है। साझेदारी फर्म: एक साझेदारी फर्म भारत में पेटेंट के लिए आवेदन कर सकती है यदि वह भारतीय भागीदारी अधिनियम, 1932 के तहत पंजीकृत है। सरकारी संगठन: भारत सरकार का कोई भी विभाग या संगठन पेटेंट के लिए आवेदन कर सकता है। विदेशी संस्थाएँ: विदेशी व्यक्ति या संस्थाएँ भी भारत में पेटेंट के लिए आवेदन कर सकती हैं यदि उनके पास भारत में व्यवसाय का स्थान या सेवा का पता है। यह ध्यान रखना महत्वपूर्ण है कि सभी मामलों में, आवेदक को आविष्कार का सच्चा और पहला आविष्कारक होना चाहिए और स्वामित्व का प्रमाण देने में सक्षम होना चाहिए
