When you fall victim to online shopping fraud in India, you have several legal avenues and forums available to seek redress, recover your money, and report the perpetrators. Online shopping fraud can encompass various criminal acts such as receiving counterfeit products, non-delivery of items after payment, unauthorized transactions, phishing scams, and fraudulent e-commerce websites mimicking legitimate brands. To tackle this, the Indian legal framework provides specific mechanisms under criminal law, consumer protection law, and specialized cybercrime reporting portals. 1. The primary and immediate step is to register a complaint on the National Cyber Crime Reporting Portal operated by the Ministry of Home Affairs. This portal is specifically designed for handling cyber financial frauds and cybercrimes against women and children. You can access this portal online and register a complaint under the category of online shopping fraud. When filing the complaint, you must provide your personal details, transaction details, bank account or credit card statements, screenshots of the conversation with the seller, the website link or social media page where the fraud occurred, and any other relevant evidence. Once submitted, the portal generates a unique acknowledgment number, and the complaint is forwarded to the local cyber cell of your jurisdiction for further action. 2. If you face immediate financial loss due to online fraud, you can utilize the dedicated cyber fraud helpline number operated by the central government. Calling this helpline promptly allows you to report the fraudulent transaction. The authorities can coordinate with various banks and digital wallets to freeze the transferred funds before the scammer can withdraw them. This mechanism operates on a multi-agency framework involving banks, intermediaries, and law enforcement agencies to intercept fraudulent money trails in real time. 3. You should also approach the local police station having jurisdiction over your area to file a First Information Report (FIR) under the Bharatiya Nyaya Sanhita (BNS) for offenses such as cheating and criminal breach of trust. If the local police station refuses to register an FIR, you have the right to approach the Superintendent of Police or Commissioner of Police under the relevant provisions of the Code of Criminal Procedure (CrPC) or the Bharatiya Nagarik Suraksha Sanhita (BNSS). Alternatively, you can approach the jurisdictional Magistrate under Section 156 of the CrPC to direct the police to register an FIR and conduct a thorough investigation. 4. In addition to criminal remedies, you can seek civil compensation and refunds by approaching the Consumer Disputes Redressal Commission established under the Consumer Protection Act, 2019. E-commerce platforms, online sellers, and service providers fall within the definition of traders and service providers under this Act, making them liable for unfair trade practices, deficiency in service, and sale of defective or spurious goods. You can file a consumer complaint before the District Consumer Disputes Redressal Commission if the value of goods and compensation claimed falls within the pecuniary jurisdiction of the district forum. The complaint must detail the transaction, the deficiency in service or unfair trade practice, and the specific relief sought, such as a full refund, compensation for mental agony, and litigation costs. 5. Furthermore, you can lodge a formal grievance with the e-commerce platform itself through their grievance redressal officer, as mandated under the Consumer Protection (E-Commerce) Rules. Every e-commerce entity operating in India is required to appoint a grievance officer and publish their contact details on their website. If the platform fails to resolve the issue within the stipulated time frame, this failure can be cited in your consumer complaint as evidence of deficiency in service. 6. To ensure a strong case, you must meticulously preserve all documentary evidence. This includes the order confirmation email, tax invoice, payment receipts, bank or credit card transaction statements, tracking details, chat transcripts with the customer support or seller, emails, and screenshots of the product listing. If the product delivered was defective or fake, retain the physical product along with its original packaging, as it may be required by the consumer forum or investigating agencies for inspection. 7. If the fraud involves a registered company operating illegally, you can also report the matter to the Ministry of Corporate Affairs through their portal, or notify the Reserve Bank of India (RBI) if the fraud involves unauthorized digital payment gateways or non-banking financial entities. Taking prompt action across multiple channels significantly increases the chances of freezing fraudulent funds, penalizing the wrongdoers, and recovering your hard-earned money through the legal process.

Dear Client Online shopping fraud can be reported through different channels depending on the nature of the fraud. If money has been transferred through UPI, card, net banking, or another digital method, the fraud should be reported immediately to the National Cyber Crime Helpline at 1930 and through the National Cyber Crime Reporting Portal. The Government portal specifically provides for reporting cyber and financial frauds online. The complainant should preserve the order details, invoice, payment receipt, bank statement, transaction ID/UTR number, screenshots of the product listing, website or social-media account, emails, WhatsApp messages, delivery information and any communication with the seller. These documents can assist the investigating authorities. A complaint may also be made to the local police/cyber-crime police station, particularly where the conduct involves cheating, impersonation or other criminal offences. For consumer-related grievances, the consumer grievance mechanism may also be considered where appropriate. In case the transfer occurred recently, it is especially necessary to report immediately, as quick reporting may help the authorities to take action against the funds that have been transferred.
