India protects overseas Indian workers through a comprehensive legal, institutional, and diplomatic framework designed to safeguard their rights, welfare, and safety abroad. The primary legislation governing this area is the Emigration Act, 1983, which regulates emigration processes to ensure that workers are not exploited by unscrupulous agents or foreign employers. Under the Emigration Act, 1983, the government has established the office of the Protector General of Emigrants along with various Protector of Emigrants offices to monitor recruitment and protect the interests of emigrant workers. To further protect vulnerable categories of workers, the Indian government implements the Emigration Check Required (ECR) system. Passport holders who have educational qualifications below a certain threshold fall under the ECR category and are required to obtain emigration clearance before traveling to specific notified countries for employment. This mechanism ensures that the employment contracts of ECR passport holders are thoroughly vetted by Indian authorities to guarantee minimum wages, proper working conditions, safe accommodation, and medical insurance before the worker leaves India. Recruitment of overseas workers is strictly regulated through registered recruiting agents. The Emigration Act, 1983 mandates that only agencies holding a valid registration certificate issued by the Ministry of External Affairs can legally recruit Indian citizens for overseas employment. These registered agents are legally bound to follow prescribed service fee limits and cannot charge exorbitant amounts from job seekers. Unauthorized or illegal agents who cheat job seekers face severe criminal prosecution and penalties under the law. Financial security and welfare support for overseas workers are significantly bolstered by the Pravasi Bharatiya Bima Yojana, a mandatory insurance scheme for ECR passport holders. This insurance policy provides coverage for accidental death, permanent disability, repatriation of mortal remains, medical hospitalization expenses, and litigation costs in foreign courts arising out of employment disputes. Additionally, the Indian Community Welfare Fund has been established in Indian embassies and consulates across various countries to provide immediate financial assistance, legal aid, food, and temporary shelter to distressed Indian workers abroad. Diplomatic missions and consular offices of India play an active frontline role in safeguarding workers. Indian embassies maintain round-the-clock helpline numbers, open-house sessions, and dedicated labour wings to address grievances related to non-payment of wages, retention of passports by employers, physical abuse, or illegal confinement. When workers face distress, Indian diplomatic missions intervene directly with local host governments, police authorities, and employers to rescue the workers, facilitate repatriation, or secure due compensation through local legal mechanisms. Bilateral labor agreements and Memorandums of Understanding signed between India and major destination countries, particularly in the Gulf region, create institutional mechanisms for joint committees to review labor conditions regularly and resolve issues amicably. These bilateral frameworks help establish standard employment contracts, streamline dispute resolution, and ensure that overseas Indian workers receive treatment at par with local labor laws or international standards.

Dear Client, There are various legal measures in India which safeguard the rights of Indians who have gone overseas for work purposes. The MEA through the Protector General of Emigrants (PGE) and Protectors of Emigrants controls some facets of overseas recruitment. It is the responsibility of PGE to protect the interests of Indian labourers and regulate recruiting agencies as per the provisions of the Emigration Act, 1983. Indian labourers can approach Indian Embassies and Consulates if they encounter problems like wage deduction and breach of contract among others. Complaints relating to foreign employers or recruiting agents may be submitted through the relevant MEA mechanisms, including the eMigrate system and the appropriate Indian Mission. For eligible emigrant workers, the Pravasi Bharatiya Bima Yojana (PBBY) provides insurance and certain other benefits, including coverage for accidental death or permanent disability and specified medical, repatriation and legal expenses. Workers should also verify that the recruiting agent is registered, carefully examine the employment contract, retain copies of their documents, and avoid unauthorised agents or sub-agents. These protections do not mean that Indian authorities can automatically enforce Indian employment law against every foreign employer; the laws of the country of employment may also apply.
