How does India combat international terrorism legally?

India combats international terrorism through a combination of domestic criminal laws, special anti-terrorism legislation, international cooperation, and intelligence-sharing mechanisms. The primary legal framework includes: Bharatiya Nyaya Sanhita, 2023 (BNS), for offences that may arise in terrorist activities. Unlawful Activities (Prevention) Act, 1967 (UAPA), which is India's principal anti-terrorism law. Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), which governs criminal procedure. Bharatiya Sakshya Adhiniyam, 2023 (BSA), which governs the admissibility and appreciation of evidence. India combats international terrorism through: Investigation and prosecution of terrorist offences. Freezing and confiscating terrorist funds and assets, where permitted by law. Monitoring and preventing terrorist financing. Strengthening border security and immigration controls. Intelligence gathering and information sharing. Cyber surveillance and investigation of online terrorist activities, in accordance with law. India cooperates with other countries by: Exchanging intelligence and criminal information. Using Mutual Legal Assistance Treaties (MLATs) to obtain evidence located abroad. Seeking or executing extradition of accused persons under applicable treaties and the Extradition Act, 1962. Working through INTERPOL to trace fugitives and share criminal intelligence. Participating in joint investigations and international law enforcement cooperation where appropriate. India also works with international organizations and follows obligations under various United Nations Security Council resolutions relating to counter-terrorism and terrorist financing. Investigative agencies involved in combating terrorism include: National Investigation Agency (NIA). State Police and Anti-Terrorism Squads (ATS). Intelligence agencies. Enforcement Directorate (ED), in cases involving money laundering or terrorist financing. Other specialized agencies, depending on the nature of the offence. Persons accused of terrorism are entitled to legal safeguards, including: The right to a fair trial. The right to be represented by an advocate. The presumption of innocence until proven guilty. The right to challenge detention or other legal orders in accordance with law. At the same time, terrorism-related offences may involve special investigation procedures, stricter bail provisions under the UAPA, and enhanced powers for investigating agencies, subject to judicial oversight and constitutional safeguards. India's approach is based on preventing terrorist acts, prosecuting offenders, protecting national security, disrupting terrorist financing, and cooperating with foreign governments to address cross-border terrorism in accordance with domestic law and international legal obligations.
