What should a person do if police demand a bribe?

If a police officer demands a bribe, the person should not pay the bribe unless acting under the directions of a competent anti-corruption agency as part of a lawful trap or investigation. The person should remain calm and, if possible, note important details such as: Name and designation of the police officer. Police station or office. Date, time, and place of the demand. Amount of the bribe demanded. Names of any witnesses present. If it is safe and lawful to do so, preserve any evidence, such as: Messages or emails. Call records, where legally permissible. Audio or video recordings, if lawfully obtained. Any documents connected with the demand. The person can file a complaint with: The State Anti-Corruption Bureau (ACB) or Vigilance Department. The Superintendent of Police or senior police officers. The Lokayukta, where applicable. Other competent anti-corruption authorities in the State. Many Anti-Corruption Bureaus conduct trap proceedings. If a person reports the demand before paying the bribe, the agency may arrange a lawful trap to catch the public servant accepting the illegal gratification. The person should provide all available evidence and cooperate with the investigation. If the complaint is not acted upon, the person may approach the appropriate court for relief in accordance with law. Demanding or accepting a bribe by a public servant is a criminal offence under the Prevention of Corruption Act, 1988 (as amended). A police officer found guilty may face: Imprisonment. Fine. Departmental disciplinary proceedings, including suspension or dismissal. Other legal consequences as provided by law. Making a knowingly false complaint is also an offence and may result in legal consequences. Therefore, complaints should be truthful and supported by available evidence. If the demand for a bribe is accompanied by threats, unlawful detention, or misuse of police powers, the person should mention these facts specifically in the complaint, as they may constitute separate offences under the Bharatiya Nyaya Sanhita, 2023 (BNS).

Dear Client, Do not voluntarily offer or pay a bribe. A demand for an undue advantage by a public servant in connection with official duties can constitute an offence under Section 7 of the Prevention of Corruption Act, 1988. You should preserve relevant evidence, such as messages or other records, where lawfully possible, and report the demand to the appropriate anti-corruption or law-enforcement authority. Dear Client, According to Section 7 of the Prevention of Corruption Act of 1988, demanding a bribe is classified as a serious offense. The person from whom a bribe is demanded is expected to refuse the request for a bribe and if possible, collect evidence for the request. The expected response in this situation is to contact the Anti- Corruption Bureau (ACB) or Vigilance Department of the state immediately and make a formal complaint so that an investigation may be conducted. A complaint may also be raised before the senior police superintendent or the State Police Complaints Authority or directly to a Magistrate under section 175(3) BNSS requesting him to issue directions for an inquiry.
