Yes, a criminal case in India can sometimes be settled outside court, but only in certain categories of offences and under specific legal conditions. Not all criminal cases can be compromised. 1. Types of cases that can be settled outside court (a) Compoundable offences Under criminal law, some offences are “compoundable,” meaning: The victim and accused can agree to settle the matter The case can be withdrawn or closed with court permission Examples often include: Minor assault Defamation Simple hurt Certain property disputes Cheque bounce cases (Section 138 NI Act) The court must approve the settlement. (b) Quasi-criminal or private disputes Many cases involving: Personal disputes Money recovery issues Family-related conflicts are often settled through compromise. 2. Cases that cannot be settled outside court Non-compoundable offences (serious crimes) cannot be privately settled, such as: Murder Rape and sexual offences (in most cases) Serious violence Kidnapping Terrorism-related offences Major fraud affecting public interest Even if parties try to settle, court approval is generally not allowed. 3. Quashing of FIR by High Court In some cases, even non-compoundable offences can be settled through: Petition under Article 226/482 (High Court powers) The court may quash the FIR if: Dispute is private in nature Parties have genuinely compromised Continuing the case serves no public interest 4. Role of Lok Adalat Lok Adalats help in settlement of: Civil disputes Compoundable criminal cases Cheque bounce cases Motor accident claims Settlement here has the force of a court decree. 5. Criminal casesareclassified I to categories such as compoundable and non - compoundable , bailable and non- bailable, cognisable and non-cognisable. compoundable can be settled during court proceeding at the time of evidence . and also can be settled outof court Whereas non- compoundable matter cannot be sttle at time of evidence but can besettled by making witnesses hostile mainly complainant and main witnesses.

Dear Client, A criminal case can be settled outside court but only under specific legal parameters governed by section 359 of the Bhartiya Nagarik Suraksha Sahita Criminal offences are treated as wrong against society as a whole meaning private parties cannot simply drop a case on their own without legal backing Settlements are strictly limited to compoundable offences that are typically minor private or individual disputes whereas heinous and serious crimes like murder rape or dacoity are non compoundable and cannot be settled outside the court. Compoundable offences are further split into two categories Those that can be settled privately between the parties without any permission and those that require formal approval from the presiding judge Once a Court legally records a compounding settlement it results in the acquittal of the accused putting a permanent end to the criminal proceedings For non compoundable cases that arise out of commercial transactions matrimonial disputes and business run ins parties cannot directly settle out of court to close a police FIR But they can approach the high court under section 528 of the BNSS to have the FIR or criminal proceedings officially quashed based on a voluntary amicable settlement.
