Dear Client, A court marriage in India cannot happen without witnesses as the presence of three witnesses is a mandatory legal requirement for a court marriage under the Special Marriage Act of 1954. The law argues that a marriage is only valid when it is solemnized in the presence of the marriage officer and three credible persons who act as witnesses to the marriage. This requirement is intended to provide a formal record and independent verification that the marriage was conducted voluntarily without coercion and in full compliance with the legal provisions of age and consent. The role of these three witnesses is quite formal they must be physically present at the marriage office during a ceremony and they are required to sign the marriage certificate along with the bride and the groom. These witnesses must provide valid identification documents such as their Aadhaar cards PAN cards or passports which are verified by the marriage officer because the court marriage is a public act of registration that changes your legal status, the law treats the testimony of these three witnesses as an essential safeguard against forced marriages. If the couple is concerned about their privacy it is important to understand that witnesses do not need to be family members they can be friends colleagues and even acquaintances While the process is public administrative the law does not require you to invite large crowds or notify your relatives, you only need to ensure that three individuals are available on the appointed day to verify the event.
