कोर्ट मैरिज के लिए कौन आवेदन कर सकता है?

कोई भी योग्य वयस्क जोड़ा स्पेशल मैरिज एक्ट, 1954 के तहत भारत में कोर्ट मैरिज के लिए अप्लाई कर सकता है। कोर्ट मैरिज के लिए योग्यता की शर्तें: दुल्हन की उम्र कम से कम 18 साल होनी चाहिए। दूल्हे की उम्र कम से कम 21 साल होनी चाहिए। दोनों पक्षों को सही सहमति देने के लिए मानसिक रूप से फिट होना चाहिए। शादी के समय किसी भी व्यक्ति का जीवित जीवनसाथी नहीं होना चाहिए। जब तक रिवाज से इजाज़त न हो, जोड़ा प्रतिबंधित खून के रिश्तों में नहीं होना चाहिए। अलग-अलग धर्मों, जातियों, राज्यों या राष्ट्रीयताओं के लोग भी इस एक्ट के तहत शादी कर सकते हैं। भारतीय नागरिकों के साथ-साथ कुछ विदेशी नागरिक भी कानूनी कागज़ात के साथ अप्लाई कर सकते हैं। कौन अप्लाई कर सकता है: हिंदू लड़का और हिंदू लड़की अलग-अलग धर्मों के जोड़े अलग-अलग जातियों के जोड़े तलाकशुदा लोग विधवा या विधुर NRI या विदेशी नागरिक जिसके पास भारतीय नागरिक हो बेसिक प्रक्रिया: शादी के इरादे का नोटिस मैरिज ऑफिसर के सामने फाइल किया जाता है। नोटिस देने से पहले आम तौर पर एक पार्टी को कम से कम 30 दिन तक ज़िले में रहना चाहिए। ऑब्जेक्शन के लिए नोटिस पब्लिश किया जाता है। अगर 30 दिनों के अंदर कोई वैलिड ऑब्जेक्शन नहीं मिलता है, तो शादी हो सकती है। शादी 3 गवाहों की मौजूदगी में पूरी होती है। मैरिज सर्टिफ़िकेट मैरिज ऑफ़िसर जारी करता है। आम तौर पर ज़रूरी डॉक्यूमेंट्स: उम्र का प्रूफ़ एड्रेस प्रूफ़ पासपोर्ट-साइज़ फ़ोटो आधार/PAN/पासपोर्ट वगैरह। अगर पहले शादी हो चुकी है तो डिवोर्स डिक्री या डेथ सर्टिफ़िकेट गवाह के पहचान के प्रूफ़ कोर्ट मैरिज पूरे भारत में कानूनी तौर पर वैलिड है।

Both must give free consent. They should not fall within prohibited blood relations unless permitted by custom. Both should be mentally competent. � Indian Kanoon +1 Under the court marriage procedure (Special Marriage Act): A notice is filed before the Marriage Officer. Usually a 30-day notice period is required. Three witnesses are needed at the time of marriage registration. � NoBroker +1 A proposal to raise women’s marriage age from 18 to 21 has been discussed in Parliament, but as of June 2026, it has not become law. �
