Land acquisition in Indian law refers to the process by which the government takes private land for a public purpose, with payment of compensation to the landowner. Today, it is mainly governed by the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (often called the LARR Act, 2013). What does “public purpose” mean? The government can acquire land for purposes like: Infrastructure (roads, railways, highways) Schools, hospitals Industrial corridors or development projects Defence and national security Key features of the 2013 law Fair compensation: Landowners must be paid compensation based on market value (often multiplied in rural areas). Rehabilitation & Resettlement (R&R): Not just owners, but affected families (like tenants, laborers) may get benefits. Consent requirement: 70% consent for PPP projects 80% consent for private projects Social Impact Assessment (SIA): Study to check how the acquisition affects people and environment. Simple example If the government wants to build a highway and your land falls in its path, it can acquire your land—but: It must follow legal procedure Pay compensation Provide rehabilitation (if applicable) Important point The government cannot just take land arbitrarily. Dear Client, Land acquisition is the legal process through which the government or authorized public agencies compulsory acquires private land for public purposes such as infrastructure development industrial projects or urbanization. In India this process is governed by the Right to Fair Compensation and Transparency in Land Acquisition Rehabilitation and Resettlement Act 2013. The primary objective of this Act is to ensure that the process is not only efficient for public development but also equitable for the displaced land holders ensuring they are fairly compensated and rehabilitated. The legal procedure for acquisition is highly structured to prevent arbitrary seizure of property it begins with a social impact assessment to determine the potential effect of the acquisition on the Community followed by a preliminary notification that the land is being considered for acquisition. The government then conducts a formal hearing to allow affected land owners to raise objections. If the government decides to proceed a final declaration is issued and a compensation package is calculated based on the market value of the land and a comprehensive rehabilitation and resettlement plan for those whose livelihoods are impacted. It is crucial to understand that public purpose is interpreted broadly under the law and can include projects for strategic defense public infrastructure or industrial corridors.
