Dear Client, A domestic violence case under the Protection of Women from Domestic Violence Act 2005 can be filed even after many years of marriage there is no specific statutory limitation. For filing an application under section 12 of the courts have consistently held that the objective of the law is to provide civil remedies and protection to the victim and therefore the procedural limitations typically associated with criminal complaints do not apply to the civil applications. Unlike certain criminal offenses where a complaint must be filed within a specific time frame one can approach a court under the Protection of Women from Domestic Violence Act at any time this applies even if you are currently living separately have been separated for several years or are already divorced. While the law does not strictly bar a case filed after a long courts to scrutinize the reasons for the delay if you are filing after many years, you should be prepared to explain why you did not report the incidents earlier. It is important to distinguish between the civil relief under the PWDVA such as maintenance protection or residence orders and penal actions such as section 498A of IPC/BNS limitation periods under the Code of Criminal Procedure or BNSS generally apply to penal offenses but do not bar civil applications seeking protection and take relief under the PWDVA.
