Further, the Supreme Court in Justice K.S. Puttaswamy (Retd.) v. Union of India [(2017) 10 SCC 1] has held that Aadhaar can be made mandatory only where specifically authorised by law, and marriage is not one such notified service. Although some Marriage Officers may request Aadhaar for administrative convenience, such requirement is merely directory and not statutory, and refusal to solemnise or register a marriage solely for non-production of Aadhaar would not be legally sustainable.
