भारत में, दूसरी शादी करने की विधि और कानूनी प्रक्रिया धार्मिक संप्रदाय, समुदाय और नागरिकता के आधार पर भिन्न होती है। यह कानूनी मामला विशेषकर धार्मिक विवाह संबंधित हो सकता है। हिन्दू विवाह अधिनियम, 1955 भारतीय कानून में धार्मिक विवाह और तलाक संबंधित मुद्दों को व्यवस्थित करता है। हिन्दू धर्म के अनुसार, एक शादीशुदा पुरुष या स्त्री को उनके पहले के साथी के चेतावनी और सहमति के साथ दूसरी शादी करने की अनुमति हो सकती है। यह आवश्यक हो सकता है कि उनके पहले के साथी की मृत्यु हो चुकी हो या उनके पहले के साथी से तलाक हो चुकी हो। मुस्लिम शादी विधि में, धार्मिक विवाह को "निकाह" कहा जाता है और इसे मुस्लिम परंपराओं और शरीयत के अनुसार व्यवस्थित किया जाता है। मुस्लिम व्यक्ति को एक समझौते या तलाक द्वारा अपने पहले पति या पत्नी से विदा करना होगा और फिर वे एक नये निकाह के लिए आवेदन कर सकते हैं। यहां एक बात ध्यान देनी चाहिए कि कानूनी मामलों में स्थानीय न्यायालयों द्वारा निर्धारित नियमों और प्राथमिकताओं के अनुसार विवाह से पहले और उसके बाद के साथी के साथ संबंधों को व्यवस्थित किया जा सकता है। इसलिए, दूसरी शादी करने से पहले और उसकी कानूनी वैधता को लेकर व्यक्ति को स्थानीय न्यायिक प्रक्रियाओं और नियमों को जांचने की सलाह दी जाती है।
