Monetary Relief refers to the financial compensation or support that a court may order under the Protection of Women from Domestic Violence Act, 2005 (PWDVA) to help a woman who has faced domestic violence. Key points about Monetary Relief: 1. Purpose: To provide immediate and adequate financial support to the aggrieved woman to meet her: - Daily expenses - Loss of earnings - Medical costs - Maintenance (for herself and her children) - Damages caused by destruction of property due to violence 2. Who can claim it: Only a woman who has faced domestic violence (physical, emotional, sexual, verbal, or economic abuse) in a domestic relationship (with husband, partner, in-laws, etc.). 3. Who pays it: The respondent (usually the husband or partner) is directed by the court to pay the amount. 4. How to claim: - File a complaint before a Magistrate under the PWDVA. - Request for monetary relief can be included in the same application. - The court may also consider interim monetary relief before final orders. 5. Mode of payment: - The Magistrate can direct a lump sum or monthly payments. - Payment may be made directly to the woman or deposited in her bank account. 6. No bar on other maintenance: This relief is separate from maintenance under Section 125 CrPC or personal laws. A woman can claim both, but any amount paid under one law may be adjusted under the other to avoid duplication.

Dear Client, "Monetary relief" under the Protection of Women from Domestic Violence Act, 2005, is a type of compensation ordered by a Magistrate. Monetary relief means the compensation that the Magistrate may order the respondent to pay to the aggrieved person. It is intended to meet the expenses incurred and losses suffered by the aggrieved person as a result of the domestic violence. This relief can be ordered at any stage during the hearing of an application seeking any relief under this Act. The Magistrate may direct the respondent to pay monetary relief to cover expenses and losses suffered by the aggrieved person and any child of the aggrieved person due to domestic violence. Such relief may include, but is not limited to: The loss of earnings. The medical expenses. The loss caused due to the destruction, damage, or removal of any property from the control of the aggrieved person. Maintenance for the aggrieved person as well as her children, if any. This can include an order under or in addition to a maintenance order under section 125 of the Code of Criminal Procedure, 1973 or any other law. In essence, monetary relief under this Act is a court-ordered financial remedy designed to help women who are victims of domestic violence recover financially from the abuse they have suffered.
